Preamble

Any order on the site www.boutiquecoeurgrenadine.com implies unreserved acceptance by the Customer of the rights and obligations referred to in these T & Cs.

The GTC are accessible on the site www.boutiquecoeurgrenadine.com by clicking on the dedicated tab. The T & Cs may be subject to change at any time by Coeur Grenadine. The GTCs applicable to each order are those in force on the Site, on the date the Order is placed.

The Customer acknowledges having read the T & Cs and expressly declares that he accepts them without reservation as soon as he confirms his Order on the Site.

Definitions

For the purposes of these T & Cs, the terms listed below will have the meanings defined as follows:

“Customer”: any natural person of full age and capable or having the authorization of his legal guardian on the date of the Order or any legal person, residing in France or abroad, placing an Order on the Site < / p>

"Order": refers to each purchase of a Product made by a Customer on the Site

"Product": refers to the items from suppliers selected by Cœur Grenadine, presented for sale on the Site, the essential characteristics of which are designated in the presentation description

Object

The T & Cs aim to define the conditions of purchase of products made on the Site by a Customer and frame the contractual relations between Cœur Grenadine (SAS, with a capital of 1000 euros registered with the RCS of Paris under the n ° 823 430 640 whose head office is at 76 Avenue du Général Michel Bizot 75 012 Paris / holder of the domain name: boutiquecoeurgrenadine.com) and the Client.

Products

Cœur Grenadine offers for purchase on its Site Products edited and manufactured by suppliers selected by Cœur Grenadine. Cœur Grenadine presents a detailed description of the Products allowing the Customer to know, before the Order, the essential characteristics of the Products. Cœur Grenadine takes care to present on the Site the most faithful possible photographs of the Products but cannot guarantee an exact and total similarity with the Products, delivered. The Customer acknowledges that the digital presentation may alter or modify the perception of colors and materials, in particular.

Product availability and prices

The Products and associated prices mentioned on the Site are valid for the current day. Adding a product to the basket does not guarantee its availability and until the Order is confirmed. In the event that a Product is available after validation of payment for the Order, Cœur Grenadine will contact you, cancel the Order and reimburse the Customer in full, as soon as possible.

Product Prices

The prices of the Products and services are indicated in Euro all taxes included (TTC). They are applicable to the validation of the Order by the Customer.

Prices inclusive of all taxes and include VAT (Value Added Tax) at the legal VAT rate in force in France at the time of the Order. Any change in the VAT rate will be reflected in the price of the Products on the date of entry into force of the new rate. Cœur Grenadine is not responsible for the payment of any possible tax, which would be claimed by a foreign administrative authority, from the Customer, due to the delivery of a Product, outside of France. The Customer will be solely responsible for this.

The price of each Product does not include shipping costs. The shipping costs vary depending on the delivery method chosen by the Customer and the amount of his basket.The shipping costs are invoiced in addition to the price of the product and indicated in the summary of the Order, before the final validation of the Order by the Customer

Payment of the Order

The total amount of an Order can be paid on the Site, via a secure payment form, by the following payment methods: VISA, MASTERCARD, CB, E-CARTE BLEUE, PAYPAL.

By placing an Order, the Customer guarantees that he is fully authorized to use the payment card for the payment of his Order and that these means of payment provide access to sufficient funds to cover all the costs of the Order.

In the event of a refusal of payment from the bank authorization center, the Order will not be placed and the Products will not be shipped to the Customer.

Customer account, ordering and confirmation

To place an Order, the Customer must connect to the Site (accessible 24 hours a day, every day, except for incidents). The Customer is invited to create a customer account and fill in the mandatory information. The validation of the account will generate a username and a password, for which the Customer remains responsible and assumes responsibility.

The Customer expressly agrees to provide only complete and accurate information.

The details of the contents of the Customer's Order are accessible via the basket that is created, as soon as the Customer selects a Product to buy it.

By clicking on the validation and payment tab of the basket, the Customer declares that he fully and unreservedly accepts all of the GTCS.

The Order will not be final until the actual payment of the total price of the Order.

The Customer will then receive by email, at the address they have been invited to enter, an Order confirmation.

Cœur Grenadine reserves the right to refuse the confirmation of any Order for legitimate reasons, such as attempted fraud, payment incident etc.

The Order is binding for the Customer upon validation of the Order, subject to the Right of Withdrawal.

Delivery and transport of the Order

The delivery of the Products can be made in mainland France, Monaco and Corsica or in Belgium according to specific conditions. Delivery of the Products will be made to the address indicated by the Customer when ordering.

The cost of delivery is calculated automatically according to the options required and in particular the destination and the characteristics of the package. These costs are indicated before final validation of the Order.

The Customer must ensure that each Product ordered can be delivered without difficulty and check that the dimensions of the packages and products specified on the product sheet adapt to the constraints specific to their home (elevators, stairs, corridors, doors landings, destination room, etc.). The Customer must therefore take all necessary measures for the smooth running of the delivery.

Any difficulty encountered during the delivery of products for which the Customer is solely responsible has the effect of making the Customer responsible for the costs of a new delivery of the products.

Cœur Grenadine undertakes to deliver the Products ordered by the Customer with packaging appropriate to the Product and to transport.The unreserved signature by the recipient of the parcel of the delivery / transport slip presented by the delivery person constitutes confirmation by the Customer of the complete and perfect receipt of the Order.Any Product damaged or lost during transport will be replaced, provided that the Customer or the recipient of the Order has made the appropriate reservations on the delivery slip presented by the delivery person. The Customer agrees to inform Cœur Grenadine, by email to contact@boutiquecoeurgrenadine.com of the problem, within a maximum of 48 hours from delivery, after this period no complaint will be taken into account.

In the event of reservations, the Customer may be asked to present the disputed packaging.

In the event of a delay in the delivery of the Order of more than 20 working days compared to the delivery times estimated at the time of the Order, the Customer can contact Cœur Grenadine at contact@boutiquecoeurgrenadine.com in order to cancel the Order and request reimbursement, unless this delay in delivery is due to a case of force majeure in accordance with the provisions of French law.

Right of withdrawal

In accordance with the provisions of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of his Order (the date indicated on the delivery slip is proof) to exercise his right withdrawal, without having to justify reasons, nor to pay penalties with the exception of the costs of returning the Products, which will remain the responsibility of the Customer.

If the fourteen (14) day period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.

The return of the Products (intact and unused) is made in their original packaging, intact, accompanied by all possible accessories and documentation, in perfect condition for resale, with the indication of the references of the Order.

The Customer will return the Products in packaging and with an adequate means of transport taking into account the characteristics of the Products. Returned Products travel at the expense and risk of the Customer. Any product damaged, incomplete, absent or whose original packaging has been damaged, will not be refunded or exchanged and will be returned to the Customer.

In the event of the exercise of the right of withdrawal and subject to full receipt of the Products returned by Cœur Grenadine, Cœur Grenadine will reimburse the Customer for the sums paid, without penalty, with the exception of shipping costs. The refund will be made no later than seven (7) days following the date of receipt of the returned Products.

In accordance with the provisions of the Consumer Code (article L221-28), the Customer is informed that he will not be able to benefit from the right of withdrawal for the following Products:

Products made to customer specifications or clearly personalized

Products likely to deteriorate or expire quickly

Products that cannot be returned for hygiene / or health reasons

Newspapers, periodicals or magazines

Product conformity

In accordance with the provisions of the Consumer Code (Articles L211-1 et seq.), Cœur Grenadine undertakes to deliver Products in accordance with the Customer's Order and is liable for any lack of conformity existing on delivery. The Customer who wishes to exercise his right of guarantee of conformity must inform Coeur Grenadine of this at contact@boutiquecoeurgrenadine.com, providing the required supporting documents.

The Customer may request the replacement or reimbursement of the Product (shipping costs included)

Guarantee of hidden defects

In accordance with the provisions of the Civil Code (articles 1641 and following), the Customer benefits from the guarantee against hidden defects on the Products. The Customer who wishes to exercise his right of warranty against hidden defects must inform Coeur Grenadine at contact@boutiquecoeurgrenadine.com, providing the required supporting documents.

It is recalled that the warranty does not apply if the defect is the result of improper use of the Product.

The Customer has a maximum period of two years from the day on which the defect or defect was discovered.

The Customer may request the replacement or reimbursement of the Product (shipping costs included).

Litigation

The GTC are subject to French law. In the event of a dispute, an amicable resolution will be preferred, by contacting Cœur Grenadine by email at: contact@boutiquecoeurgrenadine.com

Failing an amicable agreement, the dispute will be submitted to the French courts, which have sole jurisdiction.
